8.1 Unless otherwise stated, all prices are in Euro, excluding VAT and transport/delivery costs (Ex Works).

8.2 Payment shall be made without any deduction or set-off. In case of late payment, the Seller is entitled to charge statutory interest.

9. Delivery and Transfer of Risk

9.1 Delivery periods are indicative and not fixed unless expressly agreed upon in writing.

9.2 Risk of loss or damage passes to the Buyer as soon as the products leave the Seller’s warehouse or when the Buyer is notified that the goods are ready for shipment.

10. Retention of Title

All delivered products remain the property of the Seller until the Buyer has fulfilled all payment obligations arising from the business relationship.

11. Warranty and Liability

11.1 Used machinery is sold “as is” and “where is,” without any warranty, except in cases of intent or gross negligence.

11.2 For new products, a warranty period of 12 months applies, unless mandatory law dictates otherwise.

11.3 Our liability is limited to the foreseeable damage typical for the contract.

12. Termination of Use

We may, at our sole discretion, modify or discontinue access to the website at any time. You are not entitled to compensation if certain features or content are permanently lost.

13. Export Control & Sanctions

The Buyer guarantees that the products will not be exported to countries subject to sanctions or embargoes (e.g., Russia sanctions according to EU regulations). A violation constitutes a material breach of contract.

14. Governing Law and Jurisdiction

14.1 These General Terms and Conditions are governed by the laws of Germany. The application of the UN Sales Convention (CISG) is expressly excluded.

14.2 Any disputes shall be submitted exclusively to the competent courts at the registered office of Maschinentechnik Hofgeismar (MTH) GmbH in Germany.
